Acceptance of Terms of Use

By registering, accessing or using any sites or services developed, operated or maintained by aheadWorks Co. ("Service"), you agree to be bound to the following terms and conditions ("Terms"). The following Terms apply to all versions of the Service, all kinds of releases, whether your Service subscription is paid or free of charge.
aheadWorks reserves the right to change, update and revise the Terms from time to time, at its discretion, by posting the most current version of the Terms at http://www.aheadoffice.com/terms_of_use.html.
Violation of the Terms will result in your account termination.
By confirming your agreement with the Terms you endorse to be bound by the most recent version of the Terms of Service. If you do not agree with the Terms you may not use any sites or services presented by aheadWorks Co.

General Terms

• The Service is intended for Adult use only. All users must be 13 years or older to access and use the Service.
• You must provide full, correct and accurate details and information required during sign up process.
• You agree to be fully responsible for your account password security. aheadWorks is not liable for any damage or data loss if your password has been discovered by any other person except the account owner.
• You must not share your account access details with any people.
• Any account under your domain must be used by one person. You can order as many accounts as you need at any time in case you are using any paid subscription for the domain.
• One person or organization is not allowed to request more than one free domain.
• You are responsible for all content and activity under your domain, including content and activity originating from other accounts of your domain.
• aheadWorks may, in its sole discretion and at any time, discontinue providing the Service, or any part thereof, with or without notice.
• aheadWorks reserves the right to refuse to provide the Service to anyone for any reason at any time.
• You can cancel your domain at any time by pressing according button in your domain administration panel. Since you confirm your will to terminate the domain, all data, texts, images, files, database including calendar, tasks, projects, contacts and other entries, and other digital materials from your domain will be erased. The domain itself will not be accessible until a new registration request for the same domain name.
• aheadWorks accepts no responsibility for any content or material loss resulting from your cancellation of your domain.
• aheadWorks claims no ownership, responsibility or intellectual property rights over any of the content or materials you provide to the Service.
• You may not use the Service for any illegal or unauthorized purpose. You must not, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws).

DISCLAIMER OF WARRANTY

THE SERVICE IS PROVIDED "AS-IS" AND "WITH ALL FAULTS" AND, TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, AHEADWORKS DISCLAIMS ALL OTHER REPRESENTATIONS AND WARRANTIES, EXPRESS, IMPLIED OR STATUTORY, REGARDING THE SERVICE, INCLUDING WITHOUT LIMITATION ITS FITNESS FOR A PARTICULAR PURPOSE, ITS QUALITY, ITS MERCHANTABILITY, ITS PERFORMANCE, ITS NON-INFRINGEMENT OF THIRD PARTY RIGHTS, TITLE, OR THE RESULTS OBTAINED BY USING THE SERVICE. AHEADWORKS DOES NOT WARRANT THAT THE SERVICE IS FREE FROM BUGS, ERRORS OR OTHER PROGRAM LIMITATIONS.
AHEADWORKS MAKES NO WARRANTY THAT (i) THE SERVICE WILL MEET YOUR REQUIREMENTS, (ii) THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, (iii) THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE SERVICE WILL BE ACCURATE OR RELIABLE, (iv) THE QUALITY OF ANY PRODUCTS, SERVICES, INFORMATION, OR OTHER MATERIAL PURCHASED OR OBTAINED BY YOU THROUGH THE SERVICE WILL MEET YOUR EXPECTATIONS, AND (V) ANY ERRORS IN THE SOFTWARE WILL BE CORRECTED.
NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED BY YOU FROM AHEADWORKS SHALL CREATE ANY WARRANTY NOT EXPRESSLY STATED IN THE TERMS OF USE.

LIMITATION OF LIABILITY

AHEADWORKS SHALL HAVE NO LIABILITY TO YOU OR ANY OTHER USER OF THE SERVICE OR TO ANY THIRD PARTY FOR ANY LOSS, EXPENSE, OR DAMAGE, INCLUDING CONSEQUENTIAL, INCIDENTAL, SPECIAL OR PUNITIVE DAMAGES AND INCLUDING LOST PROFITS OR LOST REVENUE, CAUSED DIRECTLY OR INDIRECTLY BY THE USE OR RELIANCE UPON THE SERVICE. USE OF THE SERVICE IS AT YOUR OWN DISCRETION AND RISK. BECAUSE SOME STATES/JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, THE ABOVE LIMITATION MAY NOT APPLY TO YOU. IF YOU ARE DISSATISFIED WITH ANY PORTION OF THE SERVICE, OR WITH ANY OF THESE TERMS OF USE, YOUR SOLE AND EXCLUSIVE REMEDY IS TO DISCONTINUE USING THE SERVICE.

Trial Domain

aheadWorks presents you a possibility to use a trial domain. The trial domain with the name of your choice (if it's free at the moment of sign up) has the only limitation of accounts number inside your free domain. All other features are fully functional and have no difference from the paid plans. There is also no trial time limitation, however all trial domains that haven't been used for 30 days are automatically deleted.
At any time you can upgrade your free domain to any paid plan, or cancel the domain.
One individual or legal entity can sign up for only one trial domain.

Payment, Refunds, Upgrading and Downgrading Terms

A valid credit card or PayPal or Google Checkout account is required for paying accounts.
The Service is billed in advance on a periodic basis and is non-refundable. There will be no refunds, upgrade/downgrade refunds, or refunds for months unused with an open plan. All fees are exclusive of all taxes, levies, or duties imposed by taxing authorities, and you shall be responsible for payment of all such taxes, levies, or duties.
Upgrading a plan or adding additional accounts will result in a new billing date effective upon the date of payment of the additional fees and, if applicable, will result in a credit of the unused portion of the existing plan.
Billing cycles change take effect after the current cycle ends.
On downgrading a plan or lowering added accounts number, you will not receive a refund or credit for the fees already paid. The downgrade will go into effect at the beginning of the next billing period.

Cancellation and Termination

You are solely responsible for the proper cancellation of your domain. You can cancel your domain at any time by clicking according button in the domain management panel. An email or phone request to cancel your domain is not considered cancellation. There will be no refund if you cancel the Service before the end of your current billing cycle, and you will not be charged thereafter. There is no cancellation fee. Cancellation is immediate, and all of your content will be immediately deleted from the Service upon cancellation. aheadWorks may at any time and for any reason terminate the Service, terminate current Terms, or suspend or terminate your account. In the event of termination, your domain will be disabled and you may not be granted access to any account or any files or other content contained in your domain, although residual copies of information may remain in our system.

Modifications to the Service and Prices

aheadWorks reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, the Service (or any part thereof) with or without notice. Prices of all Services, including but not limited to subscription plan fees to the Service, are subject to change upon 30 days notice from us. Such notice may be provided at any time by posting the changes to the aheadOffice website (www.aheadOffice.com) or the Service itself. aheadWorks shall not be liable to you or to any third party for any modification, price change, suspension or discontinuance of the Service.
